Ignacio Ixta has been in state prison for 11 years following the conviction.
The man’s friends and family say they found additional evidence in the case. Prosecutors say Ixta brought information to their attention which brought into question the credibility of the key prosecution witness.
Officials with the DA’s office their decision is based on the fairness of the trial. They say it isn’t based on possible evidence someone else committed the crime.
It’s expected the charges could be reversed at an April 12th hearing. Prosecutors say they are reevaluating the case to decide whether they will seek a new trial.
