Prosecutors decided not to retry a DUI case in Santa Barbara County man involving a man who had a controversial confrontation with police.
The Santa Barbara County District Attorney’s office says it won’t seek a second trial for Tony Denunzio. The first trial ended in a mistrial.
Prosecutors say they decided to drop the case after a judge ruled today a key blood alcohol test which they contend shows DeNunzio was driving under the influence was ruled inadmissible.
The DUI case received widespread attention because after a Santa Barbara police officer stopped the man in October of 2011, he and some witnesses alleged excessive force was used in his arrest.
Police, and other witnesses contended he was resisting. Prosecutors decided the evidence in the scuffle was unclear, so they didn’t file charges against DeNunzio or the officer for the confrontation.
