The Santa Barbara County District Attorney’s office says it will re-try a high profile DUI case which ended this week in a hung jury.
District Attorney Joyce Dudley says she feels they have a responsibility to pursue the charges against Tony DeNunzio.
In October of 2011, Santa Barbara Police stopped him after they say he was driving erratically. Some people say he resisted arrest, while others say police used excessive force in taking him into custody.
He was tasered, and suffered broken ribs.
However, following an investigation by the DA’s office, prosecutors decided there was insufficient evidence to pursue resisting arrest charges against DeNunzio, and excessive force charges against the officer involved in the incident.
